Terms of Use
These Terms of Use govern access to and use of Passeport Batterie, a SaaS platform for generating battery QR codes and maintaining the digital battery passports required by Regulation (EU) 2023/1542.
1. Purpose of the service
Passeport Batterie lets a Company account (a battery manufacturer or importer placing batteries on the EU market) generate QR codes for its batteries, create and maintain the corresponding digital passports, and make the passport data required by the Regulation available — to the public, to approved economic operators, recyclers, and authorities — according to the access tier each data field belongs to.
2. Acceptance
Creating a Company account, accepting an invitation to join one as a member, or otherwise using the service constitutes acceptance of these Terms of Use. If you do not agree to them, do not use the service.
3. Account and subscription
The service is subscribed to at the Company level. A Company account has one or more members, each holding a role (owner, admin, collaborator, or invited partner) that determines which passport sections they can view or edit. Subscription and billing are managed by the owner role; fees depend on the number of published passports and member roles, as set out in the applicable order form.
4. Your responsibilities
The Company is solely responsible for the accuracy, completeness, and lawfulness of the data it enters or approves for publication in a passport — including declared values such as carbon footprint or recycled material content. Passeport Batterie provides the tools to create, update, and publish that data; it does not independently verify declared values against the physical battery. Each member is responsible for the actions taken under their own account and must keep their credentials confidential.
5. Passport data and public access
Each published passport is reachable through a unique, non-guessable link encoded in its QR code. Passport fields are grouped into access tiers: public fields are visible to anyone holding the link, without needing to log in; additional fields are visible only to authenticated, verified approved economic operators, recyclers, or authorities, consistent with the tiered-access model described on the compliance page.
6. Availability and long-term guarantee
A published passport remains publicly readable for at least 10 years from its publication, regardless of the Company's subscription status — a commitment that goes beyond what the Regulation requires and survives the end of a subscription. Outside that specific guarantee, the service is otherwise provided on a best-effort availability basis.
7. Intellectual property
The Passeport Batterie software, interface, and documentation remain the property of its publisher. The Company retains ownership of the battery and passport data it enters; by publishing a passport, it grants the access described in §5 to the extent needed to operate the service.
8. Liability
Passeport Batterie is liable for the proper operation of the service it operates, within the limits set out in the applicable order form. It is not liable for the accuracy of data entered by a Company, for the Company's compliance with Regulation (EU) 2023/1542 beyond providing the tools described above, or for the consequences of a Company's own breach of these terms.
9. Termination
A Company may terminate its subscription under the conditions set out in its order form. Termination ends access to the Company dashboard but does not affect the long-term public-availability guarantee described in §6 for passports already published.

- Notice period and exact conditions for subscription termination by either party
- Governing law and competent jurisdiction (§10)
- Legal contact address / company registration details (§12)
- Whether a specific liability cap (amount or formula) should be stated in §8
